COVID-19 Webinar #5 - Changes to the public health direction from 4 February 2022

Did you know the COVID-19 vaccination Direction has changed for a third time in just three months?

The Workers in a healthcare setting (COVID-19 vaccination requirements) Direction (Direction) (No. 1) took effect from 10 November 2021. It has since been revoked and replaced by Direction “(No. 2)” which took effect from 16 December 2022; and on 4 February Direction (No. 2) was revoked and replaced a third time by a third Direction, same name but numbered “(No. 3)”.

We recommend joining us in this webinar if you are an:

  • employer – so you can know what you can and cannot reasonably require of persons entering your private practices, whether they are staff members or otherwise; or
  • employed doctor or doctor under a service agreement – to understand what your personal duties are to comply with the Direction.

For those who attended our COVID-19 Webinar#4 on November 2022, this webinar will update you as to your current duties under the Direction.  We will cover two key changes including the:

  • narrowing of the scope of the public health direction; and
  • change to requirements for staff members with medical contraindications and COVID-19 testing requirements.


Further, in this webinar we will clearly explain:

  • Who qualifies as a 'worker'' under the Direction?
  • What the term 'healthcare setting'' means as referenced in the Direction?  In other words, what practice settings are covered by the Direction.
  • What the COVID-19 vaccination requirements are, including what, when and how an employee is to be vaccinated against COVID-19?
  • What evidence workers must provide to the employer of their compliance with the COVID-19 vaccination?
  • The role of risks assessments in assessing refusals by workers to be vaccinated if the worker has a medical contraindication?
  • What exceptions apply to the requirement that the worker receive a COVID-19 vaccination?
  • What additional measures unvaccinated “workers in healthcare” must take, in order to be permitted to work?
  • What records you, as an employer, must hold, with respect to unvaccinated workers in healthcare?
  • What measures the Direction permits employers to take, to have an unvaccinated worker lawfully work during a critical workforce shortage?
  • What the consequences (both pecuniary and criminal) are for both a doctor and an employer, of not complying with this Direction?
