Paid Family and Domestic Violence Leave
From February 1 2023, employees of non-small business employers (employers with 15 or more employees) can access 10 days of paid family and domestic violence leave every 12 months. Employees of small businesses can access this leave from 1 August 2023.
All employees in the Fair Work System (including part-time and casual employees) will be entitled to 10 days paid family and domestic violence leave in a 12 month period. This new entitlement will replace the existing entitlement of 5 days unpaid family and domestic violence leave under the National Employment Standards. This leave will be available to employees upfront, which means they won’t have to accumulate it over time. However, unlike annual leave and personal leave, this paid leave will not roll-over or accumulate year to year if it isn’t used.
Up until the new paid leave becomes available to employees, they can still access the five days of unpaid family and domestic violence leave.
