New Births, Deaths and Marriages Registration Act to commence

New laws will enable parents of trans or gender diverse children under the age of 16 to apply to alter their child’s record of sex so that it aligns with the child’s identified sex from 24 June 2024. Doctors who have a professional relationship with the child are authorised to provide the associated assessments and reports as ‘developmentally informed practitioners’ under the legislation.

The new Births, Deaths and Marriages Registration Act 2023 will commence on 24 June 2024. It introduces significant changes for the Queensland Registry of Births, Deaths and Marriages.

Under the new laws, parents of a trans or gender diverse child under the age of 16 may apply to alter the child’s record of sex, so that it aligns with the child’s identified sex. This type of application must be accompanied by a report from a ‘developmentally informed practitioner’ who has a professional relationship with the child. The practitioner’s role is to assess the child’s understanding of the meaning and legal implications of the application.
