Fair Work Act Changes – Protecting Workers Entitlements

As part of the new Protecting Worker Entitlements laws, there have been changes to the Fair Work Act.

Some of these changes commenced in July 2023 such as:

  • changes to unpaid parental leave
  • interactions between enterprise agreements and workplace determinations
  • protections for migrant workers

The most recent changes came into effect in December 2023 and January 2024 regarding:

  • employee authorised deductions
    • An employee needs to give their permission in writing for an authorised deduction from their pay and all deductions are required to be recorded and kept in an employee record.
  • right to superannuation in the National Employment Standards (NES)
    • The NES now includes the rights to superannuation contributions. Unpaid or underpaid superannuation can now be enforced under the Fair Work Act by more employees or an employee organisation.
