Update: Secure Jobs, Better Pay Bill Passed
On December 2 2022, the Fair Work amendment (Secure Jobs, Better Pay) Bill 2022 passed Parliament and will shortly become law. On Tuesday 6 December 2022, the Bill was formally accepted by the Governor General, and as a result it has received Royal Assent.
This piece of legislation aims to deliver fairer workplace relations systems for Australian workers. The Bill amends the following workplace relations laws relating to bargaining, job security, gender equity and new protections for employees. Some of the components of the Bill are below.
- Job Security and gender equity are now principle objects of the Fair Work Act with a view to achieving fairer wages and equal remuneration for work of equal value.
- The prohibition of pay secrecy by converting a positive right for employees to disclose (or not disclose) information concerning their own remuneration structure as well as the right to ask other employees about their remuneration.
- Broader protection against sexual harassment for all workers including candidates.
- Enhancing flexible working provisions requiring employers to make genuine efforts to identify alternative working arrangements if the request cannot be accommodated.
- A prohibition on employers engaging employees on fixed term contracts (except where an exemption applies) for a period of two or more years, or which has been extended more than once.
- An amendment that aims to promote a supported bargaining system.
- Clarification on the Better off Overall Test (BOOT) and safeguards that do no leave workers worse off.
