AMA response to the Report on review of Section 92 agreements

The review of Section 92 of the Health Insurance Act 1973 was conducted in response to concerns raised by the AMA in 2019 about the procedural fairness of the Section 92 process, where persons under review by the PSR agree with the Director to make an acknowledgement of inappropriate practice in connection with their rendered services.

The AMA broadly accepts the recommendations of the review, noting some have been made redundant by the Philip Review. In general, the recommendations supporting increased transparency at all stages of the process and reducing the complexity of the MBS which we strongly agree with. The AMA also accepts that while the process has been deemed fair, improvements should still be made to the treatment of persons under review.
