AMA Member Portal - Terms of Access and Use
1. Overview
This member portal is provided by the Australian Medical Association Limited (AMA) as a service to members. Members can use the member portal to:
- update their details
- share additional information about themselves with other members
- communicate directly with other members.
Your use of the member portal is governed by the following terms and conditions (Access Terms).
2. Your responsibility for your password and login
All AMA members have their own login name and password. You are responsible for all activities that occur under your login name.
You must immediately notify the AMA of any unauthorised use of your login.
3. Profile
Your profile will display the following information from the AMA membership database:
- your preferred name and title
- your State or Territory AMA
- your practice group(s)
- your primary speciality
- the year you joined the AMA
You can update your details using the member portal or by contacting your State or Territory AMA.
You can choose to include the following additional information in your profile:
- Profile image
- Current role
- Biography
- Experience
- Education
- Expertise
- Ways you would like to become more involved in the activities of the AMA:
- Providing mentorship
- Sitting on boards or committees
- Providing expert opinion
- Conference presenting
- Outreach activities
- Opportunities to collaborate
You can delete this additional information at any time.
The default position is that your profile is not visible to other AMA members. You can change this setting in the member portal.
4. Direct messaging
The member portal includes the ability for AMA members to send and receive direct messages.
The default setting is that you do not want to send or receive direct messages. You can change this setting in the member portal. If you change this setting, then any AMA member will be able to send you direct messages.
Each AMA member is responsible for any direct messages they send. Please note that the member portal does not have the ability for AMA members to delete or recall direct messages after they have been sent.
The AMA:
- does not edit, monitor or screen direct messages
- is not responsible for the content of any direct messages (including defamatory, offensive or illegal content)
- reserves the right to examine direct messages and to remove any direct messages that may be objectionable or violate these Access Terms.
If you think that a direct message is in breach of these Access Terms or otherwise inappropriate, please contact itsupport@ama.com.au.
5. Links in direct messages to third party content
AMA members may include links to third party sites in direct messages. The AMA does not review these links and cannot warrant that any third-party sites do not contain harmful code. Accordingly, you should not click any links unless you trust that site.
6. Content of direct messaging
You must not send direct messages that contain or link to:
- any material that is illegal, offensive, abusive, indecent, defamatory, obscene, menacing, discriminatory, pornographic, misleading or deceptive or in breach of copyright, trademark, confidence, privacy or any other right or is otherwise injurious to third parties
- advertising for any goods or services (other than goods or services offered by the AMA or a State or Territory AMA)
- solicitation for anyone to become members of any commercial enterprise or organisation (other than the AMA or a State or Territory AMA)
- harmful code
- any political campaigns (other than campaigns conducted by the AMA or a State or Territory AMA)
- financial or personal advice or recommendation.
7. Intellectual property
The member portal is owned or licensed by the AMA. Subject to these Access Terms and any terms applicable to third-party content, you have a non-exclusive, non-transferable, right to use and access the member portal for personal, non-commercial use.
As between the AMA and you, you own the content of your profile and any direct messages sent by you. Subject to paragraph 9, you grant a license to the AMA and other AMA members to use any intellectual property rights in this information to further the activities of the AMA.
8. Consent to use of your personal information
All profiles and direct messages are held in accordance with the AMA’s privacy policy.
If you choose to make your profile visible, you consent to other AMA members using the information in your profile to further the activities of the AMA.
Subject to paragraph 9, if you choose to send another AMA member a direct message, you consent to them using the information in that direct message to further the activities of the AMA.
9. Activities that require additional consent
Unless you have their prior written consent, you must not:
- copy or use information from a direct message or someone else’s profile for any purpose that does not further the activities of the AMA
- forward a direct message to anyone else (other than itsupport@ama.com.au)
- publish a direct message or information from someone else’s profile
- disclose a direct message or information from someone’s profile to anyone else.
10. Other prohibitions
You must not:
- use the member portal to harass, cause harm, damage or loss of any kind whatsoever to the AMA, the staff of the AMA, the members of the AMA or to any other person
- decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, or create derivative works from the member portal
- use any network monitoring or discovery software to determine the website architecture, or extract information about usage, individual identities or users
- use any software, device, or manual process to monitor or copy this website or its content with the AMA’s prior written permission
- use data mining, robots, screen scraping, or similar automated data gathering, extraction or publication tools
- modify or copy: the layout of this website; or any computer software or code contained in this website.
11. Termination of access
The AMA may terminate access to the member portal temporarily or permanently at any time without giving any explanation or justification for the termination of access.
The AMA may suspend the access of one, more or all AMA members at any time.
12. No warranty
The member portal is provided on an ‘as is’ basis.
To the maximum extent permitted by law, the AMA does not make any warranties, express or implied, concerning the member portal, including any implied warranties of merchantability or fitness for a particular purpose.
13. Third party claims
You indemnify the AMA and its officers, employees and agents from and against any cost, expense, fee, loss or damage (including reasonable legal costs and expenses) or liability incurred by any of them arising from any claim, demand, suit, action or proceeding by any person where such loss or liability arose out of, in connection with or in respect of:
- your breach of these Access Terms; or
- your use of the member portal or information obtained from the member portal.
14. Governing law
These Access Terms are governed by the laws of the Australian Capital Territory.
You agree to the non-exclusive jurisdiction of the Courts of the Australian Capital Territory to determine any dispute arising out of these Access Terms.
15. Other general terms
If any part of these Access Terms is held to be invalid that part will be severed, and the rest of these Access Terms will continue to be valid and enforceable.
Termination of these Access Terms will not end those provisions that are capable of surviving.
